PLEASE SCROLL DOWN AND READ THE SUBSCRIBER AGREEMENT BELOW. This Subscriber Agreement governs your use of information services provided by BookConnector. By submitting the Advanced Connector purchase form, you agree to be bound by the terms of this Agreement.

1. Privacy. Registration data and other information about you is subject to our Privacy Policy. If you are located outside of the United States, note that information that you provide to us is being sent to the United States. By subscribing to BookConnector, you consent to your data being sent to the United States.

2. Fees and Payments. You agree to pay the fee and any other charges incurred in connection with your BookConnector email id (hereafter referred to as your user name) and password. The fee is billed when first ordered.

3. Renewal. Your subscription to Advanced BookConnector services account will remain in effect throughout the one-year subscription period unless we terminate it or you notify us of your decision to terminate your subscription. Your subscription will renew annually at your request (you won't be charged unless you authorize the renewal). The annual fee amount is based on the un-discounted price of the Advanced services at the time that the annual fee is renewed.

4. Limitations on Use.

   1. Only one individual may access BookConnector using the same user name or password.

   2. The Advanced BookConnector services are associated to a single individual, and can be used for all manuscript titles belonging to the individual. If the subscriber wishes to use the Advanced Connect! services for additional authors, a new subscription must be purchased.

   3. You agree not to sell, publish, distribute, retransmit or otherwise provide access to the content received through BookConnector to any individual or business entity, unless the content is explicitly allowed by BookConnector.

   4. You agree not to use BookConnector for any unlawful purpose. We reserve the right to terminate or restrict your access to BookConnector if, in our opinion, your use of the site may violate any laws, infringe upon another person's rights or violate the terms of this Agreement. Also, we may refuse to grant you a user name that impersonates someone else, is protected by trademark or other proprietary right law, or is vulgar or otherwise offensive.

5. Discussions, Third Party Web Sites, Services and Software. We may link to, or promote, web sites or services from other companies on the BookConnector site, or offer you the ability to download software from other companies. You agree that we are not responsible for, and do not control, those web sites, services and software.

6. Changes to Subscriber Agreement. You understand that BookConnector and Petrucci's West LLC reserves the right to modify this agreement at any time, without notice. It is your responsibility to review this agreement regularly (through My BookConnector) and terminate your subscription if you disagree with any of the changes. Continuing to use BookConnector upon any change of this agreement will imply your agreement with that change.

7. General. This Agreement contains the final and entire agreement between us regarding your use of BookConnector and supersedes all previous and contemporaneous verbal or written negotiations, understandings, or agreements regarding your use of BookConnector. We may discontinue or change BookConnector, or its availability to you, at any time. This Agreement is personal to you, which means that you may not assign your rights or obligations under this Agreement to anyone. No third party is a beneficiary of this Agreement. You agree that this Agreement, as well as any and all claims arising from this Agreement, will be governed by and construed in accordance with the laws of the State of Washington, United States of America applicable to contracts made entirely within Washington and wholly performed in Washington, without regard to any conflict or choice of law principles. The sole jurisdiction and venue for any litigation arising out of this Agreement will be an appropriate federal or state court located in Washington. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods. BookConnector is a trademark of Paul Petrucci and Petrucci’s West LLC.
